Texte de la mention d'origine vs facteurs publiés de la Partie 323 pour fabricants et équipes produit

Methodology: Part 323 factors · qualification logic · human review

Paste your country-of-origin marketing claim before it ships. Get a scored pre-check report — is it an unqualified “Made in USA” (all or virtually all required), an “Assembled/Designed in USA” that implies an origin it doesn’t have, a copy that claims US and foreign origin at once, or a state/percentage claim that needs its basis stated — based on the FTC Made in USA Labeling Rule (16 CFR Part 323). A heads-up, not a legal opinion.

1. What the engine owns

Severity-ranked findings from pasted country-of-origin wording against heuristics derived from the FTC Made in USA Labeling Rule (16 CFR Part 323 — the all-or-virtually-all standard for unqualified claims, the assembled/designed partial-claim rules, the prohibition on contradictory US-and-foreign designations, and the mail-order reach of § 323.3). Check families: unqualified claims (“Made in USA” / “American-made” with no qualifier); partial claims (“Assembled in USA”, “Designed in USA” implying manufacture); contradictions (a US claim and a foreign origin in the same copy); clarity (state and percentage claims needing a basis); and context advisories (a “from imported parts” qualifier to make conspicuous, “US company ≠ Made in USA”) that never invent a supply-chain fact. Scores dock per HIGH/MEDIUM/LOW finding (advisories never dock); the rule snapshot is dated by the engine version — it is not synced with regulator pages in real time. Demo is labelled Rule-based — never silent mock.

2. What optional AI may do

Explain or polish findings when a key is configured. Upstream failure returns 502. No invented findings, no quotes from copy you did not paste, no bill-of-materials or customs lookup the engine did not run.

3. What you must do

  • Review findings against your own bills of materials, cost accounting and customs determinations — only you know whether the product really is all-or-virtually-all US.
  • Apply fixes in your own packaging, ads and pages — OriginPrecheck never publishes or connects to ERP or customs portals.
  • Treat output as decision-support, not a country-of-origin certification or legal advice.

4. What we deliberately do not do

  • Bill-of-materials, cost-accounting, customs or facility verification — those facts live outside the pasted text.
  • Continuous monitoring of live product pages or automated publishing.
  • Compliance probabilities or enforcement-prediction numbers — outside the regulator nobody can compute what it will decide.
  • Legal review — Part 323 checks read claim wording patterns, not your full obligations; customs marking under other laws is out of scope. Non-US origin regimes appear as labeled advisories only.

Heuristic pre-check — not a country-of-origin certification or legal advice. No bill-of-materials, cost-accounting, customs or facility verification and no enforcement prediction performed.
